What is “No Fault” Divorce?

Minnesota is a “no-fault” divorce state. This means that the Courts do not want to hear about assigning fault to either party. It only is concerned with whether or not the marriage relationship is irretrievably broken (can’t be saved). The Court will grant the “dissolution of marriage” (divorce) to the Petitioner even if the other party (the Respondent) disagrees. . The only issues that remain will involve child custody, parenting time, child and/or spousal support and property division, any of which can be challenged.

The only time the courts will even consider one party’s “bad” actions is when those actions have had a detrimental effect on that party’s relationship with a minor child or when it involves financial issues (ie. gambling or outrageous spending by one party.).
